Defino v Soha
Plaintiff underwent a balloon dilatation of her esophagus by co-defendant at Hospital in Kingston. She was discharged from that facility and presented at the Benedictine Hospital Emergency Department several hours later complaining of chest pain. Defendant physician examined her, ordered laboratory and radiological testing and ultimately discharged her home with explicit discharge instructions. Two days later, plaintiff re-presented to the Emergency Department and was diagnosed as having an esophageal tear which required emergency surgery and ultimately lost the lower two-thirds of her esophagus. The case was settled by the co-defendants prior to trial. Debra Young tried this case in Ulster County Supreme Court which resulted in a defense verdict for the Emergency Room physician.
